Lease or disposal of waterfront land

What is Waterfront Land?

Waterfront land is defined by the Crown Land Management Act 2009 as Crown land that is comprised in an allotment that includes or abuts either:

  • the high water mark on the seashore
  • the edge of any other navigable waterway or navigable body of water in the state.

Waterfront land is generally reserved for public enjoyment and recreation. And there are restrictions on what activities can be conducted in the following areas:

  • River Murray
  • coastal.

Lease or disposal of waterfront land

If the Minister proposes to lease or dispose of waterfront land (by granting a fee simple) then the Minister must place a notice a local and state newspaper setting out:

  • the location of the land
  • the fact the land is proposed to be disposed
  • any other information the Minister thinks fit
  • an invitation to members of the public to provide feedback.
