What is an easement?

An easement is an agreement made between parties to give an individual, a company, a council or other authority the right to use a landowner’s property for a particular purpose.

An easement does not grant any ownership rights on the land, it is merely a registered right to use a portion of another person’s land.

In many cases, when ownership of a property is transferred, the easement rights are also transferred.

Easements over Crown land

Easements can be granted over all types of Crown land, pastoral leases or land under the control of another Crown agency, where appropriate consent is given.

Statutory easements

Certain bodies such as SA Water and ETSA have rights to maintain their infrastructure, which in some cases are required to be formalised.
